James C. Stebbins

James Stebbins has had an active and diverse litigation practice in West Virginia for almost 20 years which includes extensive experience at both the trial and appellate levels. Mr. Stebbins has tried over 25 cases to verdict and has been counsel of record in more than 20 reported appellate decisions in both Federal and State Courts in West Virginia. He has successfully represented numerous local and national clients in cases involving insurance defense, insurance coverage litigation, bad faith, public entity defense, mass tort litigation, commercial litigation, oil and gas, worker’s compensation, real estate, “deliberate intent” claims and employment law. Mr. Stebbins has also more recently been serving as a mediator and has been appointed as a discovery commissioner by the local judiciary. Among his recent engagements, Mr. Stebbins has successfully represented:

A West Virginia city that received summary judgment in a personal injury action based upon the Governmental Tort Claims and Insurance Reform Act;

A local contractor in a personal injury case with over $900,000 in claimed damages who received a defense verdict after a 2 week trial;

A local lumber company that obtained a declaratory judgment that an alleged timber trespass was covered under a commercial general liability policy;

A national insurer in a coverage dispute involving a claim of coverage for alleged construction defects;

A national insurer in a bad faith case who received summary judgment in a complex matter;

A national insurer in a case that received a declaratory judgment pursuant to a “liquor liability” exclusion in its policy.
