G. Kurt Dettinger’s practice emphasis is complex matters in the finance and mineral industries, focusing primarily on the representation of banks in specialty finance transactions, investment banks in the underwriting and sale of tax-exempt and taxable bonds and mining entities and land holding companies in mineral law matters. Mr. Dettinger also advises clients on matters involving corporate law and tax law, including state and federal tax controversies. Recent representative engagements include:
- Representation of super-regional bank in loan transactions financing the acquisition, refurbishment and leasing of hundreds of railcars;
- Representation of super-regional bank in loan transactions financing the manufacture and sale of longwall mining equipment;
- Representation of banking syndicate led by an internationally-recognized investment banking firm in connection with the underwriting and sale of approximately $200,000,000 of tax-exempt surface transportation improvements special obligation notes issued in three series to finance highway construction projects in West Virginia;
- Representation of banking syndicate led by an internationally-recognized investment banking firm in connection with the underwriting of up to $125,000,000 of tax-exempt lease revenue refunding bonds;
- Representation of banking syndicate led by an internationally-recognized investment banking firm in connection with the underwriting and sale of approximately $100,000,000 of tax-exempt lottery revenue bonds;
- Representation of banking syndicate led by an internationally-recognized investment banking firm in connection with the underwriting and sale of approximately $26,000,000 of tax-exempt revenue refunding bonds benefitting State Institutions of Higher Education;
- Representation of leading regional investment banking firm in the underwriting and sale of approximately $18,000,000 of tax-exempt hospital revenue bonds and hospital refunding revenue bonds and taxable hospital refunding revenue bonds issued in three series to finance certain capital projects and to refund prior bonds;
- Representation of borrower in the extraction industry in connection with the issuance and sale of debt instruments;
- Representation of mining company in connection with program to acquire significant coal reserves;
- Representation of land holding company in connection with the leasing and subleasing of its coal properties; and
- Representation of real estate investor in the divestiture of significant income-producing real estate holdings in West Virginia.
Mr. Dettinger, a native of Charleston, West Virginia, is admitted to practice before the West Virginia Supreme Court of Appeals and the United States District Court for the Southern District of West Virginia, and is also a licensed certified public accountant.
Mr. Dettinger completed his undergraduate studies at Marshall University in 1996, earning a B.B.A. in Accounting with a minor in Finance. Upon graduation, Mr. Dettinger entered the banking industry and worked as a commercial banker prior to enrolling in the West Virginia University College of Law in 2000. While in law school, Mr. Dettinger served as the Associate Editor and Issue One Editor of Volume 104 and Volume 105 of The West Virginia Law Review, respectively, and served as Contributing Author of "Survey of Developments in the Law of West Virginia," 104 W. Va. L. Rev. 619 (Spring 2002). As part of his legal studies, Mr. Dettinger served the Federal Judiciary as Judicial Intern to the Honorable Robert Bruce King, Circuit Judge, United States Court of Appeals for the Fourth Circuit. Mr. Dettinger received his J.D. from the West Virginia University College of Law in May 2003, where he graduated Order of the Coif.
Mr. Dettinger is a member of the West Virginia State Bar and the West Virginia Society of Certified Public Accountants, and serves as the Secretary/Treasurer of the Judge John A. Field, Jr. American Inns of Court.
